Terms of Service for Validating Credit Card Information
Article 1 (Purpose)
These Terms of Service set forth a series of procedures for verifying the validity of credit card information through a credit card company after NHN KCP Corp. (hereinafter referred to "NHN KCP") receives the user's credit card information collected by The Walt Disney Company (Korea), LLC (“Merchant”) from Merchant, and establishes the rights and obligations of each user.
Article 2 (Effect and Amendment of Terms of Service)
The contents of these Terms of Service shall be posted on PC-App/Web, Mobile-App/Web, or shall be notified to the user in other ways, and shall take effect when the user agrees hereto.
NHN KCP may amend these Terms of Service if it is deemed necessary for the use of the service, and if NHN KCP amends these Terms of Service, such amendment will be notified to users at least one (1) week before the effective date in the same way as in paragraph (1), specifying the effective date and reasons therefor. However, in the case of amendment to the Terms of Service that are unfavorable to the user, such amendment will be notified to the user at least thirty (30) days before the effective date.
Article 3 (Matters not Stipulated in the Terms of Service)
Matters not specified in these Terms of Service shall be subject to the provisions of related laws such as the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. (hereinafter referred to as the “Information and Communications Network Act”), and the Personal Information Protection Act.
Article 4 (Definition of Terms)
The term “credit card information validation service” shall mean (i) a service in which NHN KCP receives the user's credit card information collected by Merchant from Merchant, (ii) confirms the validity of the credit card information through a credit card company, and delivers the result value to Merchant.
The term “credit card” shall mean financial cards such as credit cards and debit cards that have been generated by a credit card company.
The term “user” shall mean a person who has received a credit card from a credit card company among users who use the Merchant credit card payment service provided by Merchant.
The term “credit card information” shall mean information such as credit card number and date of birth that users provide to Merchant in order to register their credit card to the Merchant credit card payment service through the credit card information validation service provided by NHN KCP.
The term "credit card information validation service" shall mean a service provided by NHN KCP in which NHN KCP checks in advance whether a credit card is valid, such as whether the validity period has expired, whether its limit has been exceeded, whether it has been reported as being lost/stolen, etc. at the time that said credit card is registered as a means of credit card payment in the Merchant credit card payment service by comparing the information with the information of the user registered with the credit card company.
Article 5 (Role of NHN KCP and Scope of Service Provision)
NHN KCP must provide/use the user's credit card information within the minimum necessary scope for the purpose of provision/use while providing the 'credit card information validation service', and it must not damage, modify, or infringe such information.
NHN KCP must safely process the provided credit card information without providing or disclosing it to unauthorized third parties.
The credit card information validation service provided by NHN KCP ends when NHN KCP delivers the results of credit card information validation to Merchant, and when a user purchases goods or services using the Merchant credit card payment service, the payment agency's terms and conditions apply.
Article 6 (Hours of Use)
In principle, the use of the “credit card information validation service” is twenty-four (24) hours a day, seven (7) days a week. However, the service may be temporarily suspended due to business or technical reasons of NHN KCP or the circumstances of the credit card company.
Article 7 (Obligations of Users)
Users shall not engage in any of the following acts:
Registering or distributing virus infection data that causes malfunction of service-related facilities or destruction and disorder of information, etc.;
Pretending to be others and inputting and disclosing information of other users;
Entering and distributing false information for the purpose of obtaining property profit for oneself or others or causing damage to others;
Other unlawful acts.
The user must comply with the relevant laws and regulations and the provisions of these Terms of Service, and must not engage in other acts that interfere with the business of NHN KCP.
If the user has engaged in any of the acts specified in paragraphs (1) to (2), NHN KCP may take measures such as restricting the use of the service and claiming for damages.
Article 8 (Exemption from Liability)
NHN KCP is exempted from liability for service provision if it is unable to provide service due to natural disasters or an equivalent force majeure event.
NHN KCP shall not be held liable for any disruption in service use due to reasons attributable to the user.
NHN KCP shall not be held liable for any damages caused by users leaking or providing their personal information to others, unless such leakage or provision was caused by reasons attributable to NHN KCP, whether intentional or unintentional.
Article 9 (Dispute Resolution and Competent Court)
In the event of a dispute between NHN KCP and users regarding the use of the service, such dispute shall be resolved through the competent court under the Civil Procedure Act.
(Effective Date) These Terms of Service will be effective from November 12, 2021.
